Welcome to Big Smile Photo Booth (hereinafter referred to as the “Company”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your use of our website and any services we provide, including SMS communications.
By accessing our website or engaging with our services, you agree to these Terms in full. If you do not agree, please refrain from using our services.

2. Use of Services
You agree to use our services for lawful purposes only. You must not use our services to:
- Violate any local, state, or federal laws
- Send unauthorized or spam communications
- Impersonate another individual or entity
3. SMS Communications
Big Smile Photo Booth offers optional informational and occasional marketing or promotional text messages.
Informational messages may include communications related to inquiries, bookings, appointments, payments, event details, reminders, and customer service.
Occasional marketing or promotional messages may include special offers, promotions, service updates, and availability.
You will only receive SMS messages after providing your mobile number and opting in to receive text messages.
SMS Opt-In Disclosure:
By checking the SMS consent box, you agree to receive informational and occasional marketing or promotional text messages from Big Smile Photo Booth. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out or HELP for assistance.
Consent to receive marketing text messages is not a condition of purchasing any goods or services.
4. Order & Payment Terms
- Services are considered booked once the required retainer and signed agreement have been received.
- Final invoices must be paid by the due date stated in your agreement.
- Additional services requested after booking may result in additional charges.
- Applicable taxes and fees will be included where required.
5. Event Services & Travel
We strive to arrive on time and provide all contracted services. However, delays caused by severe weather, traffic, venue restrictions, equipment failure, force majeure, or other circumstances beyond our control are not guaranteed against.
If travel outside our standard service area is required, additional travel fees may apply.
6. Refunds & Cancellations
Due to the nature of our event services:
- All retainers are non-refundable.
- Payments made toward completed services are non-refundable.
- If a service disruption occurs due to equipment failure or an error on our part, we will work with the client to provide an appropriate resolution, which may include a partial refund, service credit, or other mutually agreed solution.
- Cancellation terms are governed by your signed service agreement.
7. Intellectual Property
Clients represent that they own or have permission to use all logos, photos, artwork, trademarks, and other materials provided to us.
Big Smile Photo Booth is not responsible for copyright or trademark infringement resulting from client-supplied materials.
8. Limitation of Liability
To the fullest extent permitted by law, Big Smile Photo Booth shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
9. Modifications
We reserve the right to modify these Terms at any time. Updated Terms will become effective upon posting with a revised effective date. Continued use of our services constitutes acceptance of any revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.
If you’re using this for your website and SMS (10DLC/TCR) registration, I also recommend adding your website URL once it’s finalized so the Terms and your Privacy Policy reference each other properly.
